Inconsistency & Interpretation

Prompted by a recent post that a non - immigrant catorgoy "0" was impossible in my boyfriends case and it could only be a non- immigrant visa catorgoy "O-A" , and basically I didn't know what I was talking about and to get my facts straight so I decided to do just that.

 

The problem is we are both right, it's as simple as that as this it depends where the visa is issued within the United Kingdom, Please don't say it should be the same or i'll scream. The reason It's not is there is inconsistency in the interpretation of the requirements, between Embassy's and Consulates for a start. Further confused between particular immigration officers interpretation which is final.

 

The basic rule is if the immigration officer is satisfied with the documents and your ability to support yourself in Thailand for a period of time you get a visa. Some embassy's want to see money in only a current account nothing else. Others will take a combination of savings and current. Others will except a combination of savings, current account and income or what ever. Some want 2 photos with the application, and in my boyfriends case just 1

 

Other embassies or consulates in other countries may be different

 

My boyfriend is over 50, but not of pensionable age. We are not married, and no children.

As you can see he would not be able to obtain a non-immigrant category "0" from the Royal Thai Embassy London unless he was over 65 and claiming a state pension in which case it would be a non-immigrant catogory "0-A" visa as the poster pointed out.

 

Category "F" To perform official duties. Category "B" To conduct business, to work, to study teaching course, to work as an English teacher, to take scuba diving or boxing lessons, to work as a sport coach, to do an internship, to work as a film-producer, journalist or reporter for a short period. Category "IM" To invest with the concurrence of the Thai Ministries and Government Departments concerned. Category "IB" To invest or perform other activities relating to investment, subject to the provision of the established laws on investment promotion. Category "ED" To study, to come on a work study tour or observation tour, to participate in projects or seminars, to attend a conference or training course, to study as a foreign Buddhist monk. Category "M" To work as a film-producer, journalist or reporter. Category "R To perform missionary work or other religious activities with the concurrence of the Thai Ministries or Government Departments concerned. Category "RS" To conduct scientific research or training or teaching in a research institute. Category "EX" To undertake skilled work or to work as an expert or specialist. Category "O" To visit Thai spouse, children, parents, voluntary job, Retirement (with State Pension) Category

To applicants aged 50 and over who wish to stay in Thailand for an entended period without the intention of working.

But he can from the Thai Consulate at Cardiff as he is between 50 and 64 and can prove the cash requirement as I pointed out. Note: The requirement for a police check and medical is very recent and did not apply before.

 

 

Category "O" (Single)

A voluntary Job, accompanying a spouse or parent who is working in Thailand Category "O" with multiple entries Pension earners, Applicants over 50 years of age and persons married to a Thai National If you are drawing a state pension, applicant will be required to provide evidence by either showing a recent bank statement showing state pension entering OR a recent letter from the department of work and pensions.

 

Please Note - Applicants aged between 50-64 will be required to produce the following:

• Last 3 Months bank statements showing a regular monthly income of more than £1400.00 or a lump sum in a CURRENT ACCOUNT (Not savings) of £20,000,00

• A recent medical certificate showing you are in good health
  

If you are Married to a Thai National you must submit -

• A copy of the marriage certificate
