Facing Down a Scam

(I was recently the victim of a scam. It didn?t happen in Thailand, but it happened while I was in Thailand. It involved something that I?ve cursed here time and again - the American ?legal system,? the culture that has been overtaken by the cancer of litigation and the people who practice within it.)

Relief finally arrived a few hours ago. Psycho Tenant is gone!

 

It is difficult to describe someone who is both mentally ill and very intelligent. Physically, she?s 5?2? and 165 lbs, big, fat, solid. Her fat stomach sticks way out. Her face is ugly, ugly and her skin is very dark. Disassociated from reality, or a chronic liar, or both, her online name is ?Cutie Patty.? Contrary to the pattern of black women being very social and having a lot of friends, I have never seen her in the company of someone she wasn?t paying.

 

For the pre-conference meeting with the judge she wore an inappropriate short skirt. Any short skirt at any time would be inappropriate for her considering her fat legs and body shape. But in a courtroom it was sickening to look at. On the day of the trial, when she had demanded to appear before twelve of her peers, she wore a midriff-peeking-out, cheap, cheap, cheaply made sky-blue two-piece set. Accented with work boots. As Andrew Dice Clay might say, ?It was a fucking horror show!!?

 

A few days earilier I was in the Civil Court office where the Court Clerks do an admirable job of maintaining the court records. I wanted to know if Psycho Tenant had filed any more papers. The clerks must maintain a professional, detached demeanor at all times to work with the overwrought people who come to them. When a passing clerk heard my inquiry she said, ?Oh, you?re in a case with the Psycho, are you? She?s a lovely person isn?t she? Just lovely!? Then she went on to her area. The clerk who was helping me said, ?Yes. We know her well. She?s in here quite often.? So I shared a bit more than I normally would, considering that they are always so professional and detached. ?Do you know that she is actually accusing me of trying to murder her!?? And the professional, detached clerk, who must always be neutral, gave me a little smile, ?Oh! Well, we wouldn?t blame you.?

 

Psycho Tenant is sadistic. She dropped the first bomb on me on Christmas day. I suspect the timing was intentional. It came in the form of a telephone message in which she threatens to ??put your ass away for the rest of your old, ugly life.? When she talks about me she actually describes herself so perfectly that I wonder if she means to or it?s subconscious: ?I think you?re a miserable person and you want to pass your little miserable lifestyle onto everybody else.? ?If you have any sense left in your fat little head, do the right thing. And you know what that is. Do the right thing! You should have never concocted?you concocted?? She is the only one who concocted anything, and every accusation she made about me was wholly concocted. She was describing herself and her own acts. Somehow that realization got to me and hurt.

 

Every time I heard from her there was something new. In her first phone message she said I had been going in to her apartment and tampering with her food. In her second message she said, ?I see you?ve included the neighbor downstairs in your criminal activity?she?ll go to prison too.? The neighbor is a 56 year old woman, a lovely person, who?s been battling lymphatic cancer and lung disease for three years. In the Answer to my Complaint Psycho Tenant writes, ?Landlord/owner attempted murder on my life by entering my apartment and contaminating food that I purchase for me. He has been entering the apartment without my permission having sex with himself and who knows what else. I have his DNA .? I fully expected more new claims on the day of the trial. Sure enough, not withstanding the fact that she was on the lookout for me, and had called the police repeatedly about me, and told me she had done so, and that there are neighbors all around who can see her door, all that not withstanding, she accused me of taking the time to pick the new locks that she had installed on her front door. Pick the locks!! Does she think this is something most people can do!? There was one more sickening accusation I will tell about in a minute.

 

We had gone to the pretrial conference with the judge on the Friday before the Wednesday trial date. Psycho Tenant had been out of control. She strode up to the table, took over the Plaintiff?s chair (she?s the Defendant, although it was hard for me to tell too, considering the assault I had been under) and loudly blurted, ?A crime has been committed!!? The judge reprimanded her three times in the five minutes he had for us that day. He had a jury waiting to come in and couldn?t give us the time that I had hoped for. Having decided to represent myself, I had a lot of questions about the jury trial process, like ?How do you handle very sensitive voir dire?? (These are questions asked of jurors during jury selection - I was going to have to ask the women if they had ever felt they had been a victim of bizarre sexual misconduct and this is a difficult question for a lady to answer when she is in a room full of strangers.) Most of the time the judge had for us at the pretrial session was wasted reprimanding the Psycho for verbally abusing me and for trying to walk out of the session when she decided it was finished.

 

The following Wednesday, on the trial date, the Judge was laying in wait for her when he opened the courtroom at 8:30 a.m. He greeted me when I entered, ?Good morning, Mr. May. Have you seen Psycho Tenant?? I told him she was in the line to enter the building through the metal detectors and he actually sent the bailiff downstairs to get her! He was going to take charge. I?ve never seen anything like that before.

 

When the bailiff escorted her in, the judge brought us forward and went directly into something he had talked about in the pre-trial conference. This was a court rule, Rule J in their Court procedures manual. Since I had gone to other pre-trials to observe, I knew exactly what he was talking about. In fact, at one point, like a little law student, I had asked him where one could find Rule J, and he referred me to the Law Library upstairs. Rule J covers technical requirements and documents that need to be prepared prior to a jury trial. This judge emphasizes that people who are going to conduct jury trials must prepare ?Jury Instructions? and he had told us that the burden of following proper procedures falls mostly on the party who requested the jury trial, in this case, the Psycho. Jury Instructions are very carefully worded sets of technical instructions that are to be read to the jury before they go off to deliberate. It requires research to find appropriate instructions for a particular situation.

 

This Judge, and probably all the judges in this branch, use this requirement to stop flakes from abusing the jury trial route. This Judge is a very sweet, smiling Japanese man, but beware of the Asian smile. He smiled at her, ?Now, Ms. Psycho Tenant, did you prepare the documents required under Rule J?? ?No, I?m not familiar with that?? Still smiling, ?Well, I mentioned it to you several times the other day, but you were trying to walk out and I had to call you back and you may not have heard. At any rate I did mention it several times.? She didn?t know what he was saying, but I did. He was saying, ?There is no way I?m letting a Psycho like you make a mockery out a jury trial and insult twelve people who have been put upon to be here. If this goes to trial, it will be before me, and me only, and it will be today, and I?ll shred you, Bitch!? That?s how everyone thinks in her presence, but of course we cannot speak the words.

 

One aspect of her mental illness is that she has a limited perception of what is going on around her socially. She thinks that because people deal with her as if she is normal, that they think she is normal. So, as usual, she didn?t understand. She thought she was still fully in control and on the way to putting me through the rigors of a jury trial. The judge then told us that we may or may not have a jury trial, but we would have our day in court, but first he wanted us to sit down with a Mediator, who he introduced in a highly complimentary manner. The Mediator stepped forward - a fine, white-haired gentleman, looking every inch the retired lawyer, from his natty togs to his round glasses. An excellent presence, beautiful manners and an all-around perfect guy.

 

The three of us went out in the hallway and sat on a bench, which is an unfortunate venue because others can hear if they want to, especially if someone talks loudly, and she does. Of course she is on me immediately. She tells him what a good tenant she is and what a sick, criminal I am. He MUST listen, as must all of us who live within the system. But no rules apply to her. She displays her mental illness - she says the following words in a public place among educated people, ??and he came into my apartment and put on my panties!? And we all have to listen and not speak what is so obvious - she?s insane. The only reason another human being would touch her panties would to be to put them in an incinerator.

 

She talks on and on. Finally, it?s my turn to say something, and I say, ?I?d like to speak to her point about what a good tenant she is. I searched the court records and found that she had falsified her application. A landlord who wasn?t mentioned, was in this court suing her for unpaid rent on September 1, the same day she signed my rental agreement.? ?And he didn?t get a cent!? she crowed with a big laugh. To her that meant that she was a winner and fully on top of the situation. It didn?t enter her mind that she was admitting being a reprehensible scum who prayed on vulnerable property owners. The former landlord, an immigrant from El Salvador of just seven years, had made a technical error in serving notices. He served her a 30 Day Notice to Terminate Tenancy and some time later served her a 3 Day Notice to Pay Rent, which negated the 30 Day Notice. The case was dismissed.

 

So the Mediator began our negotiation. The Psycho mentioned our telephone conversation in which she tried to jack me up for $2,000 for the cost of moving. ?Do you know what it costs to move these days!?? ?How much?? ?$2,000.? I was in shock from having just talked to a lawyer who had told me that his fee in a jury trial could run to $6,000 or more. Thus I had agreed to $1,500 with Psycho Tenant, because that seemed so much better than $6,000. Unfortunately for her, she would not agree to sign anything to show that she would move in exchange for the money. She wanted me to just hand her cash. ?You will have to trust me. I?ll be gone in three days.? Absolutely ludicrous. But that was then and this was now, and I had done A LOT of research and a tremendous amount of preparation. I was as ready for a jury trial as anyone could be who has no idea what the hell they are doing.

 

Also, on the Sunday a few days before the trial date, I had gotten word that she was actually moving, so, euphoric and sensing an opportunity to find out her new address, information that might be useful for future police reference, I drove to Richmond to stake out and surveil. I watched from a distance through binoculars. She had a U-Haul truck that said ?Rent Me. $19.95 per day.? Two black kids were loading it. ?Do you know what it costs to move these days!?? Apparently it costs less than $100.

 

When they pulled out with the load, I jumped down from my perch, ran to my car and raced off in pursuit, choosing parallel routes and using other surreptitious chase techniques I had seen in movies. (Which, of course, where I had also learned how to pick locks.) After a couple of blocks I thought I had lost them because they weren?t crossing an intersection that I expected to see them cross. I drove up to the intersection and they were stopped at the curb 50 or 60 feet away. I was too close! I thought I had been made! I slammed my high-powered Honda CR-V into reverse, and wound the transmission into a loud squeal as I backed the length of the block. A neighbor watched me with interest, no doubt thinking, ?That white boy is cray-zee!?

 

I waited for a while, then, heart pounding and hands shaking, I crept forward in my unmarked. I eased back up to the intersection and the truck was still parked. Had I been made? Were they making escape plans? Were they just waiting me out? I backed up again, this time more sanely, and swung around to a nearby intersection where I could see them. They were unloading. Good news, I hadn?t lost them and they hadn?t seen me. Bad news, she was only moving four blocks. Good news, I had her new address.

 

So, with the knowledge of her move, its cost and her new address, I was sitting in the mediation, a little uncomfortable as her cheap Wal-Mart panties were chaffing my ass. My witness, her abused and robbed-of-$3,000-rent former landlord walked past us on the way to the courtroom. She looked at him and said, ?And you?re next, Sebastian.? He was visibly shaken. As always, we civilized folk sit and listen mutely. The Defendant had just threatened my witness.

 

The mediator asks me to ?take a walk? so he can talk to her alone. After a long time he comes to speak with me. Now he?s visibly shaken. The reserved gentleman, the professional mediator with the flawless manners, who had assured the two of us he would not take sides, shared his thoughts, ?She?s fucking crazy! She must be hearing voices!?

 

After an heroic effort on his part, she agreed to my proposal of the refund of her security deposit of $835 along with the forgivness of three months unpaid rent. The really good news was that she would be gone that afternoon! She wanted $200 cash on the spot to get another U-Haul. The balance of $635 would be exchanged for the keys in the presence of a policeman who would also do a walk-through of the unit with us. In the end, that is exactly what happened. I handed the officer a check and she handed him the keys. It was the perfect way to receive possession from a scary tenant. To my surprise the apartment was in excellent condition. A little cleaning and touch up and it would be ready to rent in a few days.

 

The bad thing about the settlement was that she absolutely would not agree to hold me ?blameless in future actions.? In other words she reserves the right to come after me in court whenever the evil spirit moves her. At first the Mediator told me in private that he had a problem with that, ?Why would you pay her money and still have this hanging over you?? But since she could not be moved, he thought about it more and said, ?If I were you I would get her out of that apartment and as far away from me as possible. I don?t think she?ll be able to get a lawyer to take a case for her and they wouldn?t have anything anyway since you were out of the country.?

So, for two weeks I had been a student ?at law?. I went to trials, haunted the law library and searched the Web. I will say that although I despise our system, the land-of-opportunity-to-enrich-lawyers-and-yourself-through-litigation; although, I despise this legally condoned ripoff system, I read the law fairly well and understand it. My local Law Library is big, clean, organized, computerized and techhed up. There are some very helpful people on staff. The place wreaks of what lawyers have so much of - other people?s money.

 

I enjoyed the study and preparation although I worked myself into a frazzle and still ran out of time. On the night before the trial I was tired and confused. I had too much evidence, too much witness testimony and not enough knowledge of the process. The logic of my case was a muddle. It was so obvious that Psycho Tenant was lying, but what material would show the facts clearly to a jury - 9 out of 12 of whom had to be convinced? I had too many evidence exhibits to present gracefully. And I had two timeline charts to show to display. They would clinch it for sure, wouldn?t they? The first one went from her date of move-in through the month of February. All of her calls to the police fell between November 25 and December 25. My second chart was the coups de gras. It was the same as the first, except that it had two more dates: November 1 - Zane May departs for Asia. February 3 Zane May returns to the USA. These dates graphically fell a month before her first call to the police and a month after the last one.

 

It was all there, but because of stress and exhaustion, at 3:00 in the morning before the trial, it was all a blur. This is what a rookie attorney must feel like the night before he has to argue his first case in front of a jury and senior members of his firm.

 

In the end, with all the preparation I had done, I was disappointed that I had missed the experience of a jury trial. Perhaps this would be my only opportunity.

So, I faced down the terrorists, Psycho Tenant on the one hand and a condescending $240-an-hour lawyer on the other. He told me that I could not go into a jury trial alone and that I could bring him a $2,000 retainer next week. An attorney that I had used once before, but who would be out of town on this particular court date, cited an old lawyer cliché for me: ?Only a fool has himself for an attorney.? Their message was clear: ?The practice of law is our gold mine. Stay the hell away!?

 

I did get one terrific boost when I was calling around to lawyers and this was from a young-sounding black fellow who told me that he really didn?t think I would need him, but he would look things over if I wanted to fax details to him. I just talked to him on the phone instead, and he told me not to worry, I would prevail and ?don?t give her any money.? If I decided that I did want to bring him in, he would charge me around $300 total. I was really surprised because, from the outgoing phone message I had heard on their answering system, it sounded like they were an aggressive Personal Injury racket with a closet full of neck braces in all sizes. Perhaps that?s why he didn?t want to give his time to such a mundane matter as Unlawful Detainer. But he took half an hour on the phone with me, and told me to call him back if I wanted to or to fax over documents if I wanted. When we hung up, I was fully rejuvenated, psyched up and ready to head for the Law Library.

 

Psycho Tenant may come for me again. I know she would like to, but I tried to give her a victory. I think it?s important to give hostile tenants the feeling that they have won. My property is exposed and vulnerable, and when I work there, my body is exposed and vulnerable. This one always thinks she is winning anyway, so I hope she in enjoying the satisfaction of having beat me. She may want more, but I think I?ve shown this terrorist that she is looking at a hardened target, not a soft one. Let her go after someone easier.

Yes, it really happened. Some people might have the imagination to invent something like this, but not me. Ventilating about it is therapeutic though.

 

Let's not talk about the panties, okay? That could put me off me feed for life!

This is about law firms going after small businesses under the "guise" of enforcing the ada act ( americans with disabilities act)

 

I think, just by looking at the sheer volume of cases they are doing it for profit ( at appx $8000 settlements per case times over 2000 cases) it is big money.

 

What I am focusing on here is just in the San diego area, nation wide it is enormus.

 

The lawer Pinnock had hundreds of cases on the books in federal court.

 

one of his "clients" Mr. Gash has many also ( all using Pinnocks firm) below is just a few, I have found hundereds by cross referencing them on the federal court acces site.

 

I found most settle out of court for about $8000, the ones that go to court ( at the request of the persons being suied) seem to be setteled in favor of the small businesses, or thrown out of court by the judge, never going before a jury as requested )

 

my advice ( request) it spread the word on this, make them ( and all the other lawyers that are doing this for profit) take every case to court.

 

also, complain to your local congress persons, the media, ect.

 

 

I have heard ( as we all have) of this going on, but until I actually looked at the federal court site and saw the volume of cases it did not have much meaning.

I realize that you don't want to piss her off but it sounds like she lied on her application, which means that you could go after her for damages. In the U.S. legal system, you have to be careful who you rent your house to. ONce they are in your house, it is 3-6 months before they can be evisted, if they fight the eviction notice. As much as I like visiting California, I don't think that I would like to either live there or do business there because of the legal ramifications.

I also heard of attorneys in L.A. , acting on their own, suing small mom and pop restaurants that have received health code citations. Search public records, sue on behalf of the public at large, the general good or whatever shyster term they have for it. I saw one of the scum that was doing it on TV saying he was doing a public service. I also saw an elderly Chinese couple that had had their business for a lifetime. They were his victims and really distraught. At that point he was operating legally, but I believe there was local legislation being worked to stop that kind of thing.

 

These scum go to law school with the intention of getting rich. They hear about "ethics" but what do they care? When they get out it's litigate or die, and there's an incredible number of them out there. If I were Emperor of the World I'd close all the law schools for five years.

 

This culture is fascinated by what cripples it. People in the rough neighborhoods stay indoors at night. Doing what? Watching crime drama. In the same way, the culture is fascinated by The People's Court, Judge Judy, Judge Brown, Divorce Court and on and on and on.

 

And I don't see any way this cancer will not spread throughout the world. We already see Western attorneys in Thailand, advising, giving seminars, etc. The cancer will come with them and it will spread to Thai society. The legal system cancer is very subtle when it starts and very insidious and ...you know...very "legal." And always under the guise of protecting and doing good.

 

I like the system of hand over a few bucks and a little tea money for the policeman. Fast, cheap, simple. But believe me, the lawyers will "save" Thailand from that soon enough.

I did not realize how big a deal it was till it happened to my business:

 

I got access to the fed court system *( usa) online and by crossref the law firms name and the person seuing us I found hundreds of cases they are involved in. ( and keep in mind its just using names) so that is just a small part of it.

 

if this were to happen in thailand, I am sure a final solution could be found at a low cost.

 

I hope these scum lawyers "get theirs" eventually by crossing the wrong group.
