Alleged Thai Killer To Head Down Under

One of two Thai men facing murder charges in Australia has withdrawn his appeal against an order for his extradition.

 

The Court of Appeal on Friday granted Thatiya Terdputham's request for the appeal to be dropped so that he can be extradited to Australia to fight the charge.

 

Mr Thatiya is one of two Thai nationals charged with the fatal stabbing of 29-year-old Luke Mitchell in Melbourne in May 2009.

 

The two suspects, who had been studying in Australia, fled back to Thailand shortly after the killing.

 

The Criminal Court ordered the extradition of both men in November 2011, triggering appeals from both suspects.

 

In withdrawing his appeal, however, Mr Thatiya said he has been detained for almost three years without progress, so he decided it would be better to fight the charge.

 

His alleged accomplice, Surat Sihaveerachart, will continue to appeal against the extradition order.

 

The Australian government cited a 1916 extradition treaty between Siam and the United Kingdom in requesting the return of the two men to Australia.

 

The Criminal Court ruled that although Thailand and Australia have no formal extradition treaty, Australia is still a Commonwealth nation so the Thai-British treaty could still be applied.
