    Glad to have revived your greying memory cells I saw the Karn Evil 9 set in the UK before they took it stateside and it blew me away, I suppose it is one of those "you had to have been there" moments that stay with us throughout life.

    Legal update, she offered me 5 million Baht cash today in front of the judge, I laughed in her face, I agreed to allow her to use Sin Somros (joint) assets for her 10 million baht bail on the condition that if she fails to comply with terms and conditions of bail the money is void and handed to me and also any court ruling that puts me in excess of 10 Million the bail money is awarded to me before I have to sequester her assets. She has spent 3 nights in jail now and accepted my terms just to get out of the shithole.

     

    I am never one to count my chickens before the eggs have hatched but I reckon that within the next few weeks and three court cases against her she will crack.

     

    Wish me luck guys, it's been an 18 month struggle often placing a strain on my current relationship, but I can see the light at the end of the tunnel now, just hope it's in my advantage and not a goods train she hits me with.

    HH if and when I win the case I am going to relax for a couple of years, Royal Dutch Shell who I have worked for on contract numerous times in the past are negotiating with me about a position in Iraq 28 days on 28 days off in Basra seem more appealing to me right now.

     

    The hearing was last Friday and since Monday was a holiday here I heard nothing until Tuesday, the court "Mah thini Mah Thini now" you need to apply for her arrest warrant, so off I trotted out to Talin Chan again. damn I was in my 90's ripped jeans my Technics T-Shirt and a pair of trainers, who do I see the freaking judge, he couldn't have cared less and then proceeded to show me his trial notes. A few things that stood out for me were:-

     

    The plaintiff was asked if he could read and write Thai, which he denied but stated he could speak a little. The only time he used his translator was to have Thai documents read to him in Thai. I was like "Holy Fuck" I spent 3.5 hours getting grilled on Thai Law in Thai?

     

    The next one was when I said the equivalent to " Why the fuck is her lawyer taking so long to look at evidence that by law had to have been submitted 7 days before the hearing, could he not of come before and looked? His trial notes said " The Plaintiff asked the defense attorney why he was taking so long to review evidence, I agreed and just warned Khun M Jai Yen na khrup.

     

    The last one was when he threw in a piece of evidence, a document I had signed in 2547 (2004) of course I said "I have never seen it before" with a few choice words, the court record stated "The defense offered new evidence to the Plaintiff and the Plaintiff within his right stated he would reply in 7 days time to the validity of said document"

     

    Anyway fast forward to Wednesday evening, I got a phone call from her brother "You Bastard, You have a warrant out against my sister" I did war him that communications between plaintiff and defense were illegal and I was recording his call, I also told him that if he checked the last email I sent him it said "Tell your sister to play ball or face the consequences' That was Feb 2554 (2011) no reply.

    He sent me an email later,"My Sister has been arrested and you won't let her post bail" of course I ignored it but now I know she has at least 10 Million Baht of mine.

     

    Is it cheap? Selective comment, I have probably shelled put approx. 1.2 Million over the past 12 months, plus my loss of earnings, but no way is she getting away with this, I set up Thai Company for a Non-Imm B pay all my taxes and insurance payments for my employees, rent on home and office on time, TOT, AIS, True Vision, MEA, I am a perfect citizen as far as credit is concerned. No way would I ever consider myself as a Rich Man, but it does take a fair bit of baht and balls to see it through

     

    To end on musical note, which I often do, My "Translator" let me go out early on the premise that I met her at 10PM at a local bar of ours that has an open mike night. When I arrived at 10;20 (Thai Traffic great excuse) i was a little shocked to see my Gibson J-200 there, this is 15000 Euro of Guitar but she just told me to play.

    On the Criminal Case three charges

     

     

    Section 137 Whoever, giving any false information to any official, and is likely to cause injury to any person or the public, shall be punished with imprisonment not exceeding six months or fine not exceeding one thousand Baht, or both.

     

     

    Section 267 Whoever, notifying the official doing oneself's duty to make any false entry in the public or official document for the aims to be used as evidence, shall be imprisoned not out of three years or fined not out of six thousand Baht, or both.

     

     

    Section 352 Whoever, being in possession of a property belonging to the other person, or of which the other person is a co-owner, dishonestly convert s such property to himself or a third person, is said to commit misappropriation, and shall be punished with imprisonment not exceeding three years or fined not exceeding six thousand Baht, or both. If such property comes under the possession of the offender on account of being delivered to him by the other person by mistake by any means whatever, or being a lost property found by him, the offender shall be liable to one-half of the punishment.

    Now the big question is, will she shell out the baht / flee/ or go to jail??

     

    She cannot shell out herself, all monies in question are "Sin Somros" (Married assets) and as such she needs my permission to use the assets to make her own bail.

    Fleeing is not possible her passport was proffered as security yesterday and is now held by the the court

     

    Most probably a member of her family will put up the monies to keep her arse out of jail for now,

     

     

    Good tune though wasn't it!

  5. Round one to Mekong.

     

    Had the preliminary criminal hearing at Dusit Kwaeng court today and blew her defense to pieces.

     

    Brief synopsis, her family lawyer for over 25 years resigned from the defense and she now has 7 days to post bail. Judge S asked me if I wished for the public prosecutor to peruse her or if I wanted to do it myself (wink wink) I will take out a warrant for her arrest next week and bail is set at 10 Million Baht.

     

    It has been a long hard battle lasting for over a year now but I am finally seeing results, let the show go on,

  6. Guitar amp pioneer Jim Marshall dies aged 88

     

    Guitar amp innovator Jim Marshall, dubbed "the Father of Loud" for creating kit used by some of rock's biggest names, has died aged 88.

     

    Mr Marshall, who originally owned a music shop in London, founded Marshall Amplification 50 years ago.

     

    He had suffered several strokes in recent years, and developed cancer at the end of 2011, his son said.

     

    A statement posted on the company's website called him a "legendary man" who led a "truly remarkable life".

     

    Jimi Hendrix and Kurt Cobain are among the musicians who used Marshall amps.

     

    Former Guns N' Roses guitarist Slash tweeted: "The news of Jim Marshall passing is deeply saddening. R & R will never be the same w/out him. But, his amps will live on FOREVER!"

     

    Motley Crue bass player Nikki Sixx also paid tribute on Twitter, saying Marshall was "responsible for some of the greatest audio moments in music's history - and 50% responsible of all our hearing loss."

     

    Speaking to Radio Four's Front Row programme on Thursday, musician Paul Weller said he used a Marshall amp that was "at least 40 years old and still sounds fantastic".

     

    "For me it's the exactly right amp for the job," said the former Jam and Style Council frontman. "I don't know if anyone's particularly improved on it, to be honest."

     

    Jim Marshall began building amplifiers in the early 1960s, using the Fender Bassman amp as a model, creating what later became known as "the Marshall sound".

     

     

    After talking to Pete Townshend and Ritchie Blackmore, who were customers at the shop, he realised there was a gap in the market to make a cheaper alternative to the other models available at the time.

     

    It took him six attempts to create an amp he was happy with.

     

    As the company grew, Mr Marshall expanded his product range, unveiling the Master Volume Marshall amps and the classic JCM800 split channel amps.

     

    "Jim rose to become one of the forefathers responsible for creating the tools that allowed rock guitar, as we know and love it today, to be born," the statement said.

     

    "In addition to the creation of the amps, chosen by countless guitar heroes and game changing bands, Jim was also an incredibly humble and generous man who, over the past several decades, has quietly donated many millions of pounds to worthy causes."

     

    Marshall amplifiers were such a fixture of the rock scene that they featured prominently in the spoof documentary This is Spinal Tap.

     

    In a famous scene from the film, guitarist Nigel Tufnel proudly showed off his Marshall stack which went up to 11. He explained it was "one louder" than usual amplifiers.

     

    In 2003, Marshall he was given the OBE for his services to music and charity. He was a regular supporter of Macmillan and the Willen Hospice.

     

    He also donated money to the Royal National Orthopaedic Hospital in Stanmore, where he was treated for tuberculosis as a child.

     

    The Marshall Amps company, which is now based in Bletchley, Milton Keynes, is celebrating its 50th anniversary with a tribute concert at Wembley Arena.

     

    Iron Maiden, Slipknot, Whitesnake and The Cult are among the bands who have been lined up to play at the September event.

     

    Mr Marshall will be remembered alongside guitarmakers Leo Fender and Les Paul for shaping the sound of the modern electric guitar.

     

    He is survived by his children Terry and Victoria and step-children Paul and Dawn.

  7. Stevie Wonder is playing his 1st gig in China and the place is packed

    to the rafters. In a bid to break the ice he asks if anyone has a request.

    One chap jumps out of his seat in the 1st row and shouts at the

    top of his voice "Play a jazz chord ! play a jazz chord!"

     

     

     

    Amazed that this guy knows about the jazz influences in Stevie's

    career, the blind impresario starts to play an E minor scale

    and then goes into a difficult jazz melody for about 10

    minutes.When he finishes the whole place goes wild. The chap

    jumps out of his seat again and shouts "No, no, play a

    jazz chord, play a jazz chord".

     

    A bit cheesed off by this, Stevie, being the professional he is,

    dives straight in to a jazz improvisation with his band

    around the B flat minor chord and really tears the place

    apart. The crowd go ballistic with this impromptu show of

     

    his musical expertise. But, still the little Chinese man

    jumps up again and shouts "No, no. Play a jazz chord, play a jazz chord".

     

    Stevie is really pissed off now that this chap doesnt seem to

    appreciate his playing ability and shouts to him from the stage

     

     

     

    " OK smart arse, you get up here and do it".

     

     

     

    The little bloke climbs onto the stage,takes hold of the mike and

     

    starts to sing........ ....

  8. Last count she had 14 times to show up at 3 courts, no show but the court records show I have been there every time.

     

    Tomorrow is her "Drop dead date" show up or criminal charges are going all the way, mind the doors.

     

    Stupid woman, she knows I have BSe and MSe ENG as well as LLB in Law (hence the reason I am a twat) and she wants to contest me?

     

    As much as I may "Joo Jee" the Thai Judicial system it is actually quite good, I have been able to present my witness list to the courts and the Judge has given me Court Orders to get her bank records etc, can't wait to see her face when she realizes I have them.

  10. Physical retribution on a day to day is not a major concern of mine, but I am watching my back as far as being "Set Up" for some criminal offense or another that could discredit me. I have been warned to expect some form of assault at / close to the court if she is found guilty and if it happens just cover self up and not retaliate, I will have someone close by to defend me it if does happen. If I retaliate it is a simple fight, if someone else defends me it is then assault.

     

    She, and her family do not know where I live and I am now very careful of places I go to especially of an evening / night time and rarely go out alone except for the local 7-11 or Family Mart, so basically just being careful.

  11. I'd be interested in seeing how farang-thai lawsuits of this nature have gone in the last 20 years.

    Thai Courts have been making available details of similar cases online as case studies for the past 5 years or so now and in the majority of cases have ruled in the plaintiffs favour. As I mentioned earlier, plaintiff lawyer will not pursue private prosecutions unless they are pretty sure of the evidence.

     

    Unfortunately all the case studies are only published in Thai and need to be googled in for in Thai, so unless you are 100% fluent in Thai you will probably need the help of a good "Translator" to find and translate them.

  12. Odd system where the lawyer can loose his license? Not bad though.

     

    As I stated, Thailand is one of the few jurisdictions where a Plaintiff may choose to pursue a Criminal Case directly without involving the authorities. In the UK, my country of origin, criminal offenses have to be reported to the Police, the Police collect the evidence and then chose if to present evidence to CPS (Crown Prosecution Service) who decide whether to charge the accused party and then they become the defendant. I am sure it is similar in the US except they use the terms Attorney General and Public Prosecutor.

     

    So, the fact that a Plaintiff and his / her lawyer can be counter sued is a safeguard mechanism against malicious or frivolous Criminal Charges being brought before the court as a private prosecution, hence the reason her lawyer is now beginning to realise that I do have the evidence or I would not have taken it so far and am still pursuing it.

     

    Why Private as opposed to Public some may ask, well to be brutally honest I do not trust the Police in Thailand, corruption operates at all levels in Thailand and the BiB are not immune to turning a blind eye for Tea Money or if influenced by people of an assumed higher standing in Thai society. I am a lone farang prosecuting my soon to be ex who has relatives holding both Retired and Current high ranking government positions, I would have had a snowball in hells chance if I went the public prosecution route at least some chance of justice going private.

     

    On the Civil cases, 2-3 weeks ago I had found more evidence of an additional 2 Million to sue her for, In Civil cases the Plaintiff has to pay 2% of the sum being sued for to the court which is paid back if court rules in Plaintiffs favour. Civil code states that the 2% has to be paid within 7 days of the claim being made, of course her lawyer objected to my late change of indictment, it is his job to defend her, and made the request that the court rejected my additional claims. I had pre-empted his reaction and had the required 40K on my person so my lawyer asked "would it be OK if we paid the fee's now", Judge ruled that if the 2% could be paid on the spot the 2 Million would be added. 10 Minute adjournment a dash to the court accounts department and we had the receipt, the look on her lawyers face was priceless.

     

    I don't profess to being a legal beagle but I have been involved in numerous Contractual disputes over the years, Disputes between client, whom I usually am consultant for, and Contractor that have gone to litigation I have been able to support the Clients Contracts Administrator in such cases with evidence, and people think engineering is all about slide rules.

     

    I was also very careful to make sure that email communications with her were only from my gmail account but addressed to her business email address, gmail is POP3 and can only be used as secondary evidence to support a claim, her corporate account is IMAP and Internet Message Access Protocol emails can be submitted as primary evidence which means anything I may have written in an email is inadmissible evidence without something to support it whereas anything she wrote to me is admissible. Her pride of using her corporate account will be part of her downfall.

     

    It's all rather good fun actually!

  13. Time for another update,

     

    Like most things in Thailand the Legal System is a drawn out and protracted process.

     

    On Monday I had the first hearing in the Criminal Case against her, Thailand is one of the few Judicial Systems in the world where a private prosecution can be taken out for a "Compoundable Criminal Offense", but unlike the in the west Criminal hearings are not simple Plaintiff v Defendant Trials but take on 4 steps.

     

    Step 1 Plaintiff charges Defendant at Criminal Court and Judge rules if there is a case to answer. DONE

     

    Step 2 Plaintiff and Defendants Lawyers review the Plaintiffs indictment at Criminal Court and Judge decides whether to proceed. DONE (Last Monday)

     

    Step 3 Plaintiff and any witnesses called present prosecution evidence before the Criminal Court and will be cross examined by Defendants lawyer. Judgement will be made on whether or not the evidence is strong enough for the Defendant to be charged. That is scheduled for 6th March. Mekong's big day out.

     

    Step 4 If Defendant is charged based on step 3, then summoned to Criminal Court to either plead guilty or to defend charges, if guilty plea is entered then minimal penalty will most likely be imposed, if she tries to defend the charges and is found Guilty then mid to upper scale penalty is more likely, which due to severity of charges will be a minimum of a suspended sentence.

     

     

    Criminal offenses are covered by the Thai Penal Code and have to follow the Criminal Procedure Code of Thailand

     

    So, that is the Criminal case underway.

     

    Civil Case 1 is the main "Petition for Divorce" and division of Joint and Marital assets, pre hearing for that is scheduled for 14th February

     

    Civil Case 2 is "Infringement Damages" this relates to her throwing me out of the house and shipping all my belongings back to UK, destroying my financial records, loss of earnings fighting the case etc etc, pre hearing on 5th March.

     

    I must admit her lawyer looked pretty worried on Monday, for a Start pursuing a private Criminal Prosecution one needs to be 100% sure, if the Courts rule that the prosecution is unfounded I am leaving myself open to counter prosecution and so is my lawyer, If I am in the wrong I could be deported and my lawyer could lose his license and face a custodial sentence so her lawyer is pretty sure now that we do have a case for her to answer. The interesting thing is that as the Plaintiff I have not yet had to show the Defendant what evidence I do have and I know he is itching to see what I do have. I cannot wait to see the look on his face when he finally gets to see it.

     

    He asked my lawyer, "Will you be making any further charges" to which he replied, "NO, Not at the Moment", the look on his face was priceless.

     

    If I win my cases and she is ordered by the courts to pay me back and she states that she does not have the funds then the fiscal paper chase starts, anyone found to be holding property or money for her can also be prosecuted as accessory to misappropriation and handling stolen goods, which are criminal charges in themselves, once I have court order that allows me to trace funds I maybe able to implicate all of her family, interesting weeks and months ahead.

     

     

    There is an undercurrent in Gobbies "Epic Countdown" Thread about how to stay busy in Thailand and what else apart from bars. Well to be honest I have spent a lot of my time pursuing my case, finding the evidence, reading up on Thai Criminal and Civil Law statutes and procedures etc. On top of that, as I mentioned in another thread I have also attained my Masters Degree via distant learning, I have another course lined up in BKK in May to get me more qualifications in Functional Safety Engineering with the option of using the company I set up last year as Thai operational arm of a group of Global Consultants if I pass the course.
