Appeal rejected in Pornthip case

The Appeals Court yesterday upheld a Criminal Court decision dismissing a criminal suit filed by US forensics expert Henry Lee against his Thai counterpart, Khunying Pornthip Rojanasu-nand.

 

The Appeals Court ruled that Pornthip was simply expressing her opinion toward the plaintiff without causing the public to hate him.

 

As a result, the Appeals Court agreed with the primary court that Pornthip had not defamed Lee in an articled published in The Nation Weekend, a news magazine.

 

Lawyer Kitti Setthachatkul filed the suit, on Lee?s instructions, against Pornthip and The Nation Weekend following the publication of an article written by Pornthip.

 

The suit named Pornthip as the first defendant and seven Nation Multimedia Group (NMG) editors, including Pongsak Srisod, editor of Nation Weekend. NMG is also publisher of The Nation.

 

In the article Pornthip wrote that she had shown Lee pictures of former MP Hangthong Thamma-wattana, who was found dead in his brother?s bedroom, and Lee had suggested Hangthong?s death may not have been a suicide.

 

The suit claimed the article had caused the public to misunderstand Lee.

 

Last year, the Criminal Court ruled that the article had not defamed Lee, reasoning that the public was already divided into two schools of thought over Hangthong?s death.
