Charter Court Dismisses Yingluck And Nine Cabinet Members From Office

The Constitutional Court on Wednesday dismissed caretaker Prime Minister Yingluck Shinawatra from office, ruling that she abused her power by transferring National Security Council Thawil Pliensri.

 

The nine Cabinet members involved in the unlawful transfer of Thawil were stripped of their positions. "The Prime Minister's status has ended, Yingluck can no longer stay in her position acting as caretaker prime minister," a judge said in a live televised ruling.

 

The remainder of the cabinet can continue working, the judge said. The judge said Yingluck violated the charter on the transfer of Thawil from position of National Security Council.

 

The transfer of Thawil Pliensri from the post of National Security Council chief was unlawful, unconstitutional and unethical.

 

Yingluck Shinawatra had a hidden agenda in ordering the transfer and also intended to benefit a relative. The court thus ruled that the transfer was prohibited by the law as it was unethical and a conflict of interest.

 

The Court ruled that only Yingluck and nine other Cabinet members who took part in Thawil's transfer must be removed from the Cabinet.

 

The others, who were not members of the Yingluck Cabinet that approved Thawil’s transfer, can remain in office as caretaker Cabinet members. The court also ruled that the caretaker Cabinet can continue its duties until the new Cabinet takes office.

 

The Constitutional Court ruled that it has no mandate to order the appointment of a new prime minister within seven days as requested by the complainant.

 

The request to the court to order the appointment of a new was made by Senator Paibul Nititawan during the trial on Tuesday. Paibul filed the abuse of power suit against Yingluck.

For those unfamiliar with the case National Security Council is not an elected position but Thawil was put in the position by the previous Democrat administration and was rather outspoken about PT overall.

 

Now if Yingluk had just replaced Thawil with the then Police Chief Pol Gen Wichean Potephosree that would have been constitutional, the issue was she replaced Pol Gen Wichean with Pol Gen Priewpan Damapong who just so happens to be Thaksin's Brother in Law, nobody believes that his divorce from Potmajan was done for nothing more than political and legal reasons.

 

Having National Security Council a PT sympathiser and the National Police Chief as inner circle Shinawatra, very close inner cycle the Brother in the Law of the one pulling the strings of this puppet government and still in control was too much for the Senate hence the reason this case was brought against Yingluk and the caretaker cabinet ministers who signed off on it.

 

​The NACC may announce whether to indite on the Rice Pledging Scheme tomorrow, this will definitely be cases against Yingluk, Kittirat and most likely Siriwat but it would surprise me if the NACC did indite then the same ten names will be on the list.

 

​Could this be the beginning of the end of the Shinawatra Clan, it is beginning to look like it.

I was having lunch as the decision was being announced. Lots o Thais were watching the TV news. One woman was angry, but most others seemed happy or at least comfortable with it. After all, PT still stay in power for the time being.

 

No faction will be completely happy with this result.

A sad day for Thai democracy. It stinks of judicial coup d’etat.

 

Can you imagine this happening in the USA or UK? The country’s majority democratically elected leader Obama or Cameron being sacked for transferring a hostile public servant appointed by the previous government..and to boot, a previous government that was unelected.

 

Well, the shit may hit the fan now.

 

Some hot headed red shirts protest...and who can blame them..they’ve had their votes stolen from them 3 times now. Protests turn ugly. Army steps in. Military coup. Unelected yellow shirt government appointed again. TIT.

I cannot imagine Thaksin not being sentenced in 2001 already. I cannot imagine Thaksin and his relatives not being behind bars for life if they tried the same things in the west.
