Maybe you can say that USA have changed to a new world.

 

I've pointed out before that invention of illegal combattants is an acceptance of the Soviet treatment of germans soldiers as not POWs (entering the country without a visa or other immigration papers), or even more obvious the north vietnamese/FNL treatment of american soldiers in Vietnam (without a war declaration or UN mandate).

Ah, but the US forces were in the Republic of Vietnam (= South) at the invitation of that government, legally recognised and a member of the United Nations. One could argue with more validity that the North Vietnamese soldiers were in the south illegally -- without any declaration of war and slipping in clandestinely through another country (Laos).

 

p.s. Hitler only declared war one time -- on the US after Pearl Harbor. If he hadn't, FDR would have had a helluva time trying to get the US Congress to declare war on Hitler. Americans were pissed off at Japan, not Germany.

Fourth Geneva Convention:

 

"Article 49. The second paragraph of Article 49 provides that persons displaced during armed conflict must be transferred back to their homes as soon as hostilities in the area in question have ceased. This right of displaced persons is often referred to as the 'right of return' and has been reaffirmed in later international treaties and conventions. State Practice also establishes this rule as a norm of customary international law, according to the International Committee of the Red Cross."

 

 

However, this did not apply to the WWII Allies or to the wars in Israel/Palestine. Only some countries are obligated to follow the Geneva Conventions, mainly the one that lose a war.
