Steve
She says Posy Floral Design in Manhattan substituted pastel pink and green hydrangeas for the dark rust and green ones she had specified for 22 centerpieces... The flowers cost $27,435.14. The lawsuit asks for more than $400,000 in restitution and damages

rchapstick
The bitch spent $27K on flowers??? I have no doubt a jury of her "peers" will find her to be VERY sympathetic.
Julian2
If she spends $27K she should be entitled to what she ordered. I imagine that she demanded a refund which was either refused or ignored and it escalated from there. The "can't color match exactly" claim is bullshit, I was involved in the florist trade for a while and for that sort of money they get exactly what they want, even if you have to fly it in from interstate. Steve
But is it big enough mistake to be worth 400k? I did a little searching of colors on Wikipedia and its not close but they got the green right I think. A partial or even full refund, okay, but 400K? Sorry, if I was a juror I wouldn't give it to them. The most I would award is the cost of the flowers.

liquidflux
Not uncommon to ask for an outrageous amount in the initial complaint. They wont get it of course. The florists lawyer will counter with a lowball offer, like 10k or so. The whole aim is to get both parties into mediation where they'll eek out some sort of settlement that leaves both sides suitably pissed off.
