The Office of the AttorneyGeneral (OAG) said yesterday it had not filed charges against Santika Club for operating as an unauthorised service premises because its owner had told police of their operation plans beforehand.

OAG spokesman Thanapich Moolpreuk told a press conference the public prosecutors based their decision on the grounds that Santika executives had notified their intention to run the place as an entertainment venue to a Thong Lor police superintendent on December 24, 2003.

 

According to the Places of Service Act,1966 (third amendment,1982), those wishing to establish a place of service must notify the authorities at least 15 days before opening their doors, he said - which had been done.

 

However, as it was not required that the premises receive a licence before opening, the Santika Club operation was not illegal, he said.

 

After the club's opening, 47 criminal cases were filed against the executives on charges of operating an entertainment venue without a licence and selling liquor during restricted hours, from June 6, 2004 to September 17, 2006. The public prosecutors put all the cases into one lawsuit.

 

Operators of the pub, White and Brothers, requested and were granted an Administrative Court's temporary injunction - allowing the pub to operate pending a ruling - based on this claim of advance notification, which was before the Places of Service Act's fourth amendment for zoning in 2003 came into effect. The evidence convinced prosecutors the club establishment had not violated the law, he said.

 

This was a separate case from the charges pending under the Building Control Act about entrances and fire escapes, for which the public prosecutors have yet to receive a case report.

 

In a related development, Department of Special Investigation (DSI)deputy chief Narat Sawetnant yesterday led a team of DSI, forensic and Disease Control officials to inspect the charred club for two hours. Narat said they were looking for additional information.

 

Police are still waiting for forensic results before considering action against those responsible for lighting fireworks at the pub, Thong Lor investigator Pol Lt Col Prawit Kanwon said. Police suspected that White and Brothers managing director Suriya Ritrabeu, has left Thailand through a neighbouring country, he added.
