There's a report in today's papers that the Southern Bangkok Criminal Court will meet tomorrow (20/09/11) at 9:00 am to deliver the verdict on the 7 defendants accused in the Santika fire. They deny all charges.

Hi,

 

Cowboy should be reasonably okay due to 2 exits, NEP is a deathtrap for sure. Patpong with that nightmarket would be a real nightmare as well.

I guess I was thinking from the perspective of someone in one of the short-time rooms above a bar on Cowboy, but I swear I wont be doing that again - money to burn, apparently ;)

BMA to pay B800,000 for five deaths in blaze tragedy BKK Post 19/05/12

The Central Administrative Court yesterday ordered City Hall to pay nearly 800,000 baht in compensation to the parents of five of the 66 victims of the 2009 Santika pub inferno.

Chavalit Larpphol, chief of the panel of judges considering the case, read out the court's verdict, saying the ruling was based on the principle of shared responsibility that the Bangkok Metropolitan Administration must shoulder.

He said even though the BMA did not cause the fire itself, the agency was still partly to blame.

If the BMA had not failed to inspect the pub, it would have not been allowed to be used as an entertainment venue before the fire broke out as revellers rang in 2009 at a New Year's Eve event.

The court determined the BMA has to accept a 20% share of responsibility for the losses suffered by the parents of five of the dead.

Mr Chavalit said those who must shoulder a greater share of responsibility are the operators of the pub and the person who lit the fireworks that led to the blaze.

The court has ordered the BMA to pay different amounts of compensation to the parents of the five dead victims.

The BMA is to pay 139,600 baht in compensation to Nusin Saenmuangsin, for the loss of his son, Punnakan, who died in the fire.

Prasert Kumpol will receive 212,000 baht for the loss of his daughter, Patcharee, while Wanna Samkhong is to receive 140,000 baht for the death of her daughter Walaya. Plaek Buamak will be awarded 140,000 baht in compensation plus 7.5% annual interest for the loss of her daughter Pantipa.

Manee Wantaweesong will get 164,000 baht in compensation plus 7.5% annual interest for the death of her son, Songpol.

The court did not explain why interest was granted on top of the compensation for some of the families.

Chairat Saeng-arun, a lawyer who represents three of the five parents, said each of the families had filed lawsuits with the court demanding the BMA pay them between 4-5 million baht in compensation. However he said the amounts awarded by the court should be acceptable. Other compensation is being demanded from the Santika operators, Mr Chairat said.

He said the court's order for state agencies to accept a 20% share of responsibility for the losses is an encouraging sign for the public.

If the BMA takes the case to the Supreme Administrative Court and should the court uphold the ruling, this principle of shared responsibility would become a precedent for similar cases in the future.

Winai Limsakul, chief of the BMA's public works department, said the agency will study the court's ruling and decide whether to appeal to the Supreme Administrative Court.

On Feb 29 , the Central Administrative Court ordered the BMA to pay 312,080 baht in compensation plus 7.5% interest to Banjob and Kornkanok Narong, for the loss of their son Krich, who died in the fire. The BMA lodged an appeal against the order with the Supreme Administrative Court on March 29.

BMA told to pay Bt3.4m over Santika (Nation newspaper 01st November 2012)

The Central Administrative Court yesterday ordered the Bangkok Metropolitan Administration (BMA) to pay Bt3.4 million in partial compensation to the parents of 12 victims of the New Year's 2009 Santika nightclub fire.

This amount is equivalent to 20 per cent of what the court believes the plaintiffs should get for the damages they suffered in the blaze.

The Santika fire, which broke out in the early hours of January 1, 2009, killed 67 people and left more than 100 others seriously injured. The parents of some victims lodged a complaint against the BMA on December 28, 2009, on grounds that the city had failed to strictly enforce building regulations and fire codes. According to them, the tragedy could have been avoided if regulations had been strictly enforced.

The lack of enough fire exits was cited as one of the reasons why many revellers were unable to get out of the nightclub, which caught fire due to a fireworks display.

The compensation amount for each of the 12 plaintiffs ranges between Bt68,000 and Bt740,000, and will be subject to an interest rate of 7.5 per cent, calculated from the day the court order was issued to the day the payments are made.

No BMA representative was present in the courtroom yesterday. Deputy Bangkok Governor Malinee Sukvejvorakij said BMA will file an appeal in line with normal legal procedures. "We understand the victims' losses and really want to help. However, at this point, we need to proceed in line with legal procedures. Without an appeal, the BMA might face a probe by the Office of the Auditor-General," she explained.

She added that the BMA would only pay if the Supreme Administrative Court rules that it do so.

Chairat Saeng-arun, a lawyer for the plaintiffs, said the court had instructed the BMA to pay the compensation within 30 days. "This is separate from the civil case filed by the victims and their relatives," Chairat said.

The BMA was ordered to shoulder 20 per cent of the compensation because there were many parties found responsible, among them the owner, Wisuk Setsawat.

Malee Thanompanyarak, whose sister died in the fire, said yesterday that Wisuk had initially offered Bt50,000 in compensation but had paid only Bt40,000. "He has never contacted us again," she said.

Last year, the Bangkok Southern Criminal Court sentenced Wisuk to three years in jail for negligence. The court ruled that Wisuk had failed to obey building regulations and to provide safety equipment and emergency exits at his Ekamai nightclub. The court also found him guilty of allowing minors to enter the site. Wisuk is free on bail pending his appeal of the ruling.
