EC to ask Constitutional Court tomorrow to rule on delay of Feb 2 election

 

 

Election Commission will tomorrow ask the Constitutional Court to rule the government or the EC has authority to delay the February 2 snap election.

 

EC’s legal advisor Somkid Lertpaibul said majority of the EC’s advisory panel have agreed that the Constitutional Court should to be consulted to settle the conflict in which the EC favoured the postponement of the snap election while the caretaker government claimed it has no authority to decide on the matter.

 

The EC will submit the request on Wednesday, he said.

 

The EC’s proposed delay based on the fact that 28 constitutencies could not hold the election, therefore, the number of elected MPs will not meet the requirement of 95 per cent to convene the first Parliamentary meeting.

 

Somkid said that the EC did not want to waste a budget of Bt3.8 billion in organising the election.

The group of 40 senators will ask the Constitutional Court to rule whether the government had violated the charter by declaring the state of emergency in Bangkok and nearby provinces, one of them said Wednesday.

 

Paibul Nititawan, an appointed senator and member of the group, said the declaration of state of emergency definitely violated Article 181 and Article 237.

 

Paibul said Article 184 prohibited the government from using state personnel to gain advantage in an election and Article 237 prohibited any political party from doing anything that would allow them to have an advantage in the election.

 

Paibul said he would file a petition with the court on Thursday.
