The punitive damages allowed under the U.S. legal system allow someone to sue and possibly get a substantial amount over actual damages. These damages are paid for by insurance companies, not doctors. The insurance company then raises the premiums paid by those doctors and by doctors who practice in fields in which there is a lot of litigation. To protect their ass against being sued, doctors order a lot of unnecessry tests, which are paid for by the patient/insurance company. Of course I want a health care system that gets rid of incompantant doctors but doctors do make mistakes and should be allowed to fix them without the probability of a large lawsuit being filed against him/her. By the way, I know of a few doctors that no longer practice, or paractice part time at a V.A. hospital, because they can't afford their current insurance premiums. cavanami Posted May 5, 2009 Report Share Posted May 5, 2009 Part of the problem is the AMA as they are suppose to maintain quality doctors and the states are suppose to investigate and license doctors. When this doesn't happen, then we get crap doctors. Everyone makes mistakes and depending on the mistake should the penalty be. Yes, sometimes the awards are waaaaaay over the top...the lady that spilled hot coffee on her piss flaps and got $$$$, etc. The courts and the judges are also waaaaay too irregular. You hear of a judge over ruling a jury's award or throwing out a legitimate case, and then the case of the lady's piss flaps get $$$$$...just no logic to it all and WE all suffer!
