Police Given Direct Line To Cell Phone Searches

 

 

DALLAS (CBSDFW.COM) – Think about all the personal information we keep in our cell phones: It’s something to consider after the U.S. Court of Appeals for the 7th Circuit ruled it is now legal for police to search cell phones without a warrant.

 

Former Dallas FBI Agent Danny Defenbaugh said the ruling gives law enforcement a leg up. “I think not only will it help them, but it could be life saving,†said the former Special Agent, who was based in Dallas.

The decision stems from an Indiana case where police arrested a man for dealing drugs. An officer searched the suspect’s cell phone without warrant.

 

The judge in the appeal case, Judge Richard Posner, agreed that the officer had to search the phone immediately or risk losing valuable evidence. Judge Posner ruled it was a matter of urgency, arguing it was possible for an accomplice to wipe the phone clean using a computer or other remote device.

 

Defenbaugh says the ruling takes into account exigent or time-sensitive circumstances that could be life saving in more urgent cases, such as child abduction. â€If the child is alive and you’re only minutes behind, that could be critical to recovering that child alive,†added Defenbaugh.

 

Paul Coggins is the former U.S. Attorney for the Northern District of Texas. Coggins says the court’s ruling pushes the envelope on privacy issues. “Does that mean officers now have the right to search through your phone, search through your search history, your photographs, your e-mails and the rest, because it could all be wiped clean,†asked Coggins.

 

Many critics are asking the same question. They call the ruling an invasion of privacy that far outweighs the needs of law enforcement.

 

Both Defenbaugh and Coggins agree that the case is likely to go to the U.S. Supreme court.

Biggest crock of BS. Saving someone's life and invading privcay are two totally different things. The only way I would ever consider cell phone searches okay is the criteria that is used for searching someone's house or car without their permission.

 

As for saving someone's life, its presumed a parent or the owner of a cell phone, the victim themselves, would not be opposed to gathering information to secure their release. Its insulting to equate the two as the article suggests from some law enforcement.

 

There is no more freedom. Its gone. They are just open about it these days.

These are the federal courts saying the federal government is master of us all. That is a bit much. Problem is that politicians of both parties would probably agree with the courts.

Well, we found it. And it is damaging, because Barack Obama was as close or closer to Derrick Bell than he ever was to Jeremiah Wright. Obama didn’t merely sit in the pews – or not -- for Derrick Bell. He didn’t just hang out with Derrick Bell for prayers. He said:

 

“Open up your hearts and your minds to the words of Professor Derrick Bell.â€

 

If we did, here’s what we’d be opening our hearts and minds to. This is a close associate of Jeremiah Wright, a man who was quoted by Jeremiah Wright regularly. This is a man who posited that the civil rights movement was too moderate because it accepted the status quo, and believed that the entire legal and constitutional system had to be transformed in radical fashion. This is a man so extreme that, as we’ve reported, he wrote a story in 1993 in which he posited that white Americans would sell black Americans into slavery to aliens to relieve the national debt, and that Jews would go along with it.

 

There’s far more coming on Derrick Bell. This is just the beginning. And this video is a smoking gun showing that Barack Obama not only associated with radicals, he was their advocate.

Middle School Teacher Is Placed On Leave After Students Discover Her Porn Past

 

 

A California middle school teacher has been placed on leave after administrators learned from students that the educator appears in porn videos available online.

 

Stacie Halas, a 31-year-old science teacher at Richard B. Haydock Intermediate School in Oxnard, was removed from the classroom Monday, three days after pupils reported spotting her in a series of X-rated clips.

 

“Maybe it's not a crime as far as the penal code is concerned, but we feel it's a crime as far as moral turpitude is concerned,†said Jeff Chancer, superintendent of the Oxnard school district.

 

In a letter sent yesterday to Haydock parents, school brass noted that they are “asking teachers to discourage the children from searching for and/or visiting these inappropriate sites. We ask that you be particularly vigilant over the next few days with respect to the Internet content being accessed by your child on his or her telephone or other Internet-ready device.â€

 

Halas can be seen in some of the videos engaging in a wide variety of sexual activity with a partner portraying a delivery man for “Big Sausage Pizza.†Instead of accepting a tip from Halas, the delivery man opens the pizza box and--surprise!--offers her a tip of his own.

 

From there, the duo engage in a variety of sexual acts on the couch of Halas’s apartment. The action is filmed by a friend of the delivery guy who is, of course, shooting a documentary. The porn clips can be found on various web sites, including Sexbot.com.

 

Halas also stars in other explicit videos in which she uses the stage name “Tiffany Six.â€

How about the right to run for office? In Missouri, an elected official was removed from a county office because he had a felony conviction (said he assaulted someone for spitting on his wife). I'd be in favour of allowing convicted felons to run for government offices in most cases. One case I would not allow felons to run is if they were convicted of trying to manipulate the political system or abuse of power while in office.

 

 

The guy should have gotten a better lawyer.

 

In some states it is really hard to get convicted of a crime

but in some states getting arrested seems to come with the turf.

Obama is half white. Furthermore he was raised by his white half and raised in an environment (Hawaii) that had very few blacks throughout his formative years. He would have be one helluva self hating guy to be anti-white. His record as President and as a public official says otherwise.

Not saying that its okay to have people with those very wrong notions as a friend is right. However, in theory, I could be guilty by association. I have many childhood friends and even present black friends who have become nation of islam, anti white, jew, anti american bigots. Some have deep ingrained issues against the majority society and see anti black sentiment in the most inane things. Anyone that knows me knows that's not me. I argue with those friends and you become friends with such people for a myriad of reasons.

 

Just like how I have white friends, very dear white friends who have friends who are devout racists. Not once did I feel those friends were racists because of how sincere and great they are to me.

 

All of us have friends we are embarassed by and kept them around because we have history. Those friends also can be great friends.

 

Its politics but I look at the person and their history of relating to people. Obama hasn't shown any indication that he believes and supports that type of thinking. His administration certainly doesn't reflect it. The lack of blacks at senior levels is evidence of that. The people he has at his senior levels are some of the very people the Jeremiah Wrights of the world speak out against: connected, rich, white folks.

The Influence Industry: Obama gives administration jobs to some big fundraisers

 

 

Obama campaigned on what he called “the most sweeping ethics reform in history†and has frequently criticized the role of money in politics. That hasn’t stopped him from offering government jobs to some of his biggest bundlers, volunteer fundraisers who gather political contributions from other rich donors.

More than half of Obama’s 47 biggest fundraisers, those who collected at least $500,000 for his campaign, have been given administration jobs. Nine more have been appointed to presidential boards and committees.

 

At least 24 Obama bundlers were given posts as foreign ambassadors, including in Finland, Australia, Portugal and Luxembourg. Among them is Don Beyer, a former Virginia lieutenant governor who serves as ambassador to Switzerland and Liechtenstein.

 

“In filling these posts, the administration looks for the most qualified candidates who represent Americans from all walks of life,†said White House spokesman Eric Schultz. “Being a donor does not get you a job in this administration, nor does it preclude you from getting one.â€

 

It is a time-honored tradition to reward political supporters with administration jobs, ambassadorships in particular. And Obama’s administration falls in line with the previous one in terms of the share of ambassadors who are political appointees rather than career Foreign Service officers.

 

The Foreign Service Act of 1980, however, states that “contributions to political campaigns should not be a factor in the appointment of an individual as a chief of mission.â€

 

Obama has appointed 59 ambassadors who were not career Foreign Service officers, and of those, 40 percent were bundlers.

 

“We think that the pendulum has swung a bit too far toward the patronage side of things,†said Susan Johnson, president of the American Foreign Service Association, which represents career officers.

 

Not all political appointees have been bad ambassadors, Johnson said, but some have been less qualified, making them “costly in terms of advancing and protecting our interests and costly for the taxpayers.â€

 

Obama has appointed campaign bundlers to a range of other jobs as well. Attorney General Eric H. Holder Jr. was a bundler, raising at least $50,000, as was Julius Genachowski, the chairman of the Federal Communications Commission, who raised at least half a million dollars.

 

Obama hired bundler Steve Spinner as a liaison in the Energy Department. According to internal e-mails turned over in a congressional investigation, Spinner pressed for staff members to finalize a government loan for Solyndra, the now-shuttered solar company in which another campaign bundler was a major investor. Spinner, according to the Obama administration, did not make any decisions affecting Solyndra.

 

At least two of Obama’s bundler-ambassadors have had rocky tenures, according to reports from the State Department inspector general.

 

Nicole Avant, a music industry executive who raised at least $500,000, served as ambassador to the Bahamas until November.

 

The inspector general wrote that her tenure was part of “an extended period of dysfunctional leadership and mismanagement, which has caused problems throughout the embassy.†The report said Avant spent roughly 40 percent of her time out of the country over a two-year period.

 

In an interview, Avant said that she inherited an embassy with management problems and that her travel was not out of line.

 

“Part of my job as a U.S. ambassador was to travel,†she said.

 

Avant is now helping the Obama campaign raise money from donors in Hollywood.

 

Luxembourg Ambassador Cynthia Stroum, a Seattle venture capitalist who raised $500,000 for Obama, was also criticized in an inspector general’s report, which said she sent her staff on a house-hunting mission, billed the government for bedding after being told she couldn’t and was “keenly interested†in the materials used for remodeling two bathrooms in her residence.

 

“Most employees describe the ambassador as aggressive, bullying, hostile, and intimidating,†inspectors wrote of Stroum.

 

Stroum did not return messages seeking comment.

 

She was replaced by another bundler, Robert Mandell, a Florida real estate developer who raised between $200,000 and $500,000 for Obama’s campaign.

 

Statistics kept by the American Foreign Service Association show that certain posts are favored for political appointees. In recent decades, many European capitals, for example, have been staffed by political appointees more than 70 percent of the time. A representative of the association called those the “well-known sumptuous posts.â€

 

All this really proves is that Obama is no different from other politicians.

All you say is very true (as usual). But elections are more emotional than logical. Can you imagine a Republican candidate having racist or seemingly racists friends? Obama knows these photos do not help him, since he made sure they stayed out of sight last time around. I expect this election is going to be a bit nastier than the last one.

Flash...difficult not to get emotional when you see the President doing everything possible to fuck up the country by dividing the population (ethnicity v. ethnicity; gender v. gender as well as socio-economically). Internationally, he and his administration clearly couldn't find their asses with both hands and a flashlight. They don't know whether to shit or go blind on stuff. Barry is a fucking disgrace. At home, he and his administration trample the Constitution or try to rewrite it; his arrogance is absolutely apalling. He's the "Prince of Fools". As noted in a foreign newspaper, the country will be able to survive and reverse what Obama could do to the country if he had 8 years. But, sadly, the country may not be able to survive the fools who vote for somebody like Obama.
