Website owner gets suspended jail term sex-scene pictures posted

The owner of a message-board website got a suspended one-year jail term and a fine of Bt20,000 after a user posted sex-scene pictures of a Thai woman on his site.

 

The Criminal Court found Pongwit Singsun 23, guilty of violations of the Computer-Related Crimes Act for allowing his website to be used to damage another person's reputation.

 

Public prosecutors charged that the crime took place from October 6 to November 30.

 

A user posted the sex-scene pictures of a woman in Nakhon Sawan, who alerted police.

 

The court initially sentenced Pongwit to years and fine of Bt40,000 but commuted the penalties by half after he pleaded guilty.

 

The court later suspend the one-year jail term and put him on probation for two years during which he must report to probation officials for eight times. He is also required to carry out social service for 48 hours.

It's happened before - when the subject of the pics complained. A uni student was arrested because Tata Young complained about faked nude photos the guy had of her on his site. The fakes were all over the internet, but that webmaster was here. His site was shut down and he was fined.

Fully agree with your site, your rules.

 

Curious though: are your servers in LoS? I just wonder how the guys like Nigel and many others run their very graphic sites with apparent impunity. And, if a site is hosted outside LoS, would it not be extremely difficult, without some deep data forensics, to show that someone made a specific post from an IP address within the kingdom? And what if you live in LoS, and own a site containing porn hosted outside? Can one still be prosecuted for violating Thai law?

 

I understand that laws and police actions don't necessarily coincide, but just wondering if anyone knows what the laws are?

And the problem is that even on a highly moderated board allowing pics/vdo/etc to be posted it would be hard to know 'who' is in any pics of Thai girls etc being shown. How to know what pics and vdo would cause the owners a problem like this? Other sites do this in one way or another, but how long before these pics cause them some sort of similar problems? If the owner/s are in Thailand (even if the ste is based outside of Thailand) they are within reach of the law in Thailand, and we all know how iffy that could be for a farang expat living there. Even if he did not go to jail, it would likely be easy enough for the cops and/or others to blackmail the owner and cause enough problems for him/her in tea money expenses, that having the pics (which really brings in little, if any, income) on a site is hardly worth the potential headaches and problems it could cause.

 

I am surprised some of the farang oriented nightlife sites that do allow this in some form or another (private forums, member forums, sponsor forums, etc) have not yet been seen to have some sort of problems doing this.

 

One 'scam' on this has already been reported with the cops looking for the BG in a pic, and then blackmailing her into revealing the name of the farang who took the pic being displayed and then (if the man can be indentified and found - and many likely could be, especially the expats) extorting him for money to keep from going to jail/court as having broken some law about either producing 'pornography' or even the law against harming a Thai's 'name' by posting such a pic.

 

So there are problems with a site letting pics of Thais be shown. And also there is the moral code of not showing a BGs pic if she has no knowledge and has not approved doing this, which this site would never allow, and rightly so in most members minds. (Even if she does approve it can backfire on her and the 'photographer' and cause them both problems with the mafioso type police force here, usually meaning the farang will bear the brunt of the extortion fees as well. And as we can see daily in the newspapers and on the news, most Thais will rat out who ever they need to to get themselves out of trouble. They are hardly 'stand-up' sorts averse to squealing on others once caught out.) :surprised:;)

Doesn't matter if the site is hosted outside of Thailand. What matters is if the cops here can get their hands on you if you live here, or visit here. Total anonymity is the only way to have a site where there are things being shown, written about, etc that the Thai authorities could use against you to extort money from you. And even then, if they do not like they can easily just ban your site from view within Thailand, which would likely hurt the site numbers enough to not make it worthwhile to do. Imagine how slow this site would be if all the expats that post here could not. (Well, they could using a proxy, but still, many just would not bother.)
