CTO Posted November 5, 2008 Report Share Posted November 5, 2008 I think the internet is another form of publishing and ISP's are exactly like newsagents bookstores. IF their is illegal stuff - make the ISP partially responsible - if a newsagent or bookstore sold illegal material it would get fined - place the blame on the ISP and ISP's would both charge a slightly higher rate and also take a very active interest in filtering and content protection. CTO Posted November 5, 2008 Report Share Posted November 5, 2008 Actually I meant the ISP - I see Hosting sites as the paper - ISP's as publishers. My basic point is self regulation doesn't work without a carrot and stick. In publishing (ink and paper) the printer and publisher can both be held responsible for offensive material - depending on the material. Obviously a printer can't be held responsible for a "Liable" case for example - however if they pri nted material of a child being raped (which is really what this is all about - very offensive material) then the printer definately get's punished. However in the IP world no one is held responsible except the consumer and the original content creater. I think if the net was widened to make the ISP and hosting companies punishable as well, then they'd very quickly self monitor as do printing and publishing companies today do (and radio / Tv) Link to comment Share on other sites More sharing options...

I also think it would put way too much strain on their system. And what about encrypted data? Hosts on the other hand can determine what is on their servers quite easy. If the internet had insisted from the beginning that those who deliver also are also responsible the industry would have grown with filtering in place.
