LOL, have not seen Stick in 5 years, could not care less if he eats & drinks free every single day of the week. It got to the point that this thread has been milked for all its worth, JIMHO of course...

I agree. This whole mess raises a number of issues, and I was focusing on, what I consider to be the ill advised and strange, angle of two US nationals duking it out in a Thai court over what someone posted on the internet and the problems it creates from a US perspective, but it also occurred to me that this also creates problems for Thailand.

 

What to do with this guy? If this US citizen goes to jail for criminal defamation because of claimes raised by another US citizen, its not only a headache for the US, but also for Thailand.

Actually the court system here is very sure and the court proceedings are moving forward appropriately, according to Thai law and in a rather timely fashion thanks to the plaintiffs lawyers insisting that the trial be held in John Galt alias Keith Summers home town of Nakorn Phanom, instead of Bangkok where the case would have taken many years instead of the successful 1st conviction accomplished in less than a year from start to conviction.

 

John Galt alias Keith Summers being charged with two years in a Thai prison given a fine and put on probation for two years is normal in almost all countries for the first offense.

 

The problem is that John Galt alias Keith Summers quickly decided to break probation and committ the exact same offence of criminal slander on the same plaintiff and is now facing the normal court processing and is soon (June 2010) and most likely going to be sentenced to the original two years in a Thai prison, which was his own choice and his own doing.

Yes well maybe the law is being followed according to the the court system. But there may be diplomatic considerations here. As Gadfly keeps pointing out. Two Thais in a slander case....who cares? Two farang in their home country? Ditto. Two farang in a Thai court... that's what keeps us reading.

If you or anyone with an American passport goes to the American Embassey here in Thailand to report a problem with the Thai police and/or Thai courts, you will be told directly and with no hesitation that you are completely under Thai jurisdiction. End of story!

 

This does not mean that you cannot procure legal and/or diplomatic assistance, but that assistance will have to be executed via the Thai police and/or court system and according to their due process and approval.

 

This IS Thailand!
